In simple terms, dissolving a marriage or civil union is the legal term for divorce. The Family Court in New Zealand can end your marriage or civil union by making an order for dissolving your marriage.
The Family Court has the authority to legally end your marriage or civil union once you and you partner have lived apart for a minimum of two years. If you have children together the Family Court must be satisfied that arrangements have been made for their care and welfare.
There are two types of marriage dissolution (divorce) applications in New Zealand:
1. If both you and your partner want a divorce – If you have grounds to do so, both you and your partner, you need to ask the Family Court for a marriage of dissolution order.

2. If only one of you wants a divorce: As the applicant, you will need to ask the Family Court to make a decision. This is known an applying for an order. What is Process Serving?
Process serving is the service of legal documents on a defendant. Defendants who are the subject of legal action must be personally notified, this notification is known as the service of process. Court proceedings are required to be served personally on a defendant by a process server within the time frame stipulated by the courts. If the documents can’t be served and the defendant is avoiding service, the courts may issue an order for substituted service.
What is a Process Server?
A process server is an individual hired by a client to personally deliver, or “serve” legal documents to an individual named in court proceedings. This service of legal documents is known as the “service of process”. It is a legal procedure required to give notice to all parties facing legal action.
